Will of Noah C. Shantz

Noah C. Shantz died accidentally at age 57 when a foundation wall he was taking down fell on him unexpectedly, crushing the lower half of his body.  During his final 5 hours of life he dictated this will, while Samuel S. Bowman transcribed.  It was also witnessed by Noah's brother Eli C. Shantz.

Text of the Will of Noah C. Shantz

In the name of God, Amen

I Noah C. Shantz of the Township of Waterloo in the County of Waterloo and Province of Ontario and Dominion of Canada, Yeoman, being of perfect mind and memory, knowing that it is appointed for all men once to die do make and ordain this my last will and testament in manner as follows:

First I give and recommend my soul into the hands of the Almighty God, hoping and believing in a remission of my sins by the merit and mediation of Jesus Christ, and my body I commit to the earth to be buried; and as [touching?] such worldly estate wherewith it has pleased God to bless me in this life, I give, devise and bequeath as follows:

First I give, devise and bequeath to my beloved wife Hannah Shantz [beloved wife?] the  annual income which may be derived from one third of all my property real and personal and that she may continue to live in my present residence.

Secondly, after payment of my just debts and funeral expenses I bequeath two-thirds of my real and personal property to be equally divided amongst all my children share and share alike, and that the first mentioned the third be divided in the same manner upon the death of my wife.

Thirdly, I hereby empower my executors to complete the residence I have commenced in such manner as they may think best.

I hereby nominate, [____?] and appoint my beloved son Aaron Shantz and my beloved friend Henry Brubacher of the town of Berlin as executors of this my last will and testament, and I authorize and empower my said executors to sell or otherwise dispose of my said property, personal as well as real to the best of their judgment and ability -- and as such manner and at such time as they shall deem to be for the greatest benefit to my heirs, and I further authorize and empower my said executors to [____?] and [____?] all necessary deed of conveyance to the purchasers of my estate.
